EXPRESS DIVORCE USA LLC β TERMS AND CONDITIONS

1. INTRODUCTION AND ACCEPTANCE
Welcome to Express Divorce USA LLC ("Express Divorce USA," "Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our websites, applications, online portals, intake systems, questionnaires, communications, and related services (collectively, the "Platform").
By accessing, registering for, purchasing, or using the Platform in any manner, you ("User," "Client," or "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
Important: If you do not agree to these Terms, you must not use the Platform. Your acceptance constitutes a binding legal agreement between you and Express Divorce USA LLC.
2. NATURE AND LIMITATIONS OF SERVICES
Express Divorce USA is a legal technology and document preparation platform. We provide automated workflows, questionnaires, document generation, secure client portals, identity verification, and administrative tools designed to assist users with uncontested divorce matters.

- β’ All information, documents, and outputs are generated based solely on user-provided inputs.
- β’ Users are solely responsible for reviewing, validating, and determining the appropriateness of any documents before signing, filing, or submission.
- β’ Express Divorce USA does not guarantee legal sufficiency, accuracy, or outcomes of any generated documents or filings.
- β’ Users acknowledge that information submitted through the Platform is provided for automated processing and commercial use and should not be submitted with any expectation of confidentiality beyond what is expressly stated in the Privacy Policy.
3. ELIGIBILITY
To use the Platform, you represent and warrant that:
- You are at least 18 years of age.
- You have legal capacity to enter into this agreement.
- Your matter is uncontested (full agreement between spouses).
- You provide true, accurate, and complete information.
- Your divorce involves a U.S. jurisdiction or spouse.
We reserve the right to deny, suspend, or terminate access if eligibility requirements are not met.
4. ACCOUNT CREATION, ACCESS, AND SECURITY
Certain services require creation of a secure client account and portal. You are responsible for safeguarding your login credentials and for all activity conducted through your account.
You authorize Express Divorce USA to perform identity verification, fraud prevention, and compliance checks using automated and manual methods. Failure to pass verification may result in denial or termination of service.
You acknowledge that we are not responsible for unauthorized access, misuse of your credentials, or actions taken through your account.
5. SERVICE STRUCTURE AND FEES
Express Divorce USA offers services that may include, but are not limited to:
- Step 1 β Document Preparation Service (e.g., $299 flat fee)
- Step 2 β Court-Ready Documents, Contract Generation, or Filing Bundles (state-specific pricing, including a $699 fee, where applicable)
All fees are disclosed prior to checkout. Prices may change prospectively and do not affect completed purchases.
6. PAYMENTS, STORED PAYMENT METHODS, AND AUTOMATED CHARGES
All payments are processed through PCI-compliant third-party payment processors.
By providing payment information, you authorize Express Divorce USA to store a tokenized payment method for:
- Completing multi-step services.
- Processing future or conditional charges you expressly authorize.
- Preventing payment failures.
Express Divorce USA does not store full credit card numbers or security codes.
Automated Charges: Certain services (including Step 2) may involve future charges disclosed at checkout. By completing payment, you expressly authorize such charges according to your selected services.
7. REFUND AND CHARGEBACK POLICY
All fees are non-refundable once service processing has begun.
Refunds may be issued solely at our discretion for:
- Duplicate payment
- Verified technical error
- Material service failure attributable to Express Divorce USA
Unauthorized chargebacks constitute a breach of these Terms.
8. ACCOUNT PORTAL ACCESS AND DATA RETENTION
Express Divorce USA may provide Users with ongoing access to a secure client portal, which may include stored documents, account history, and Platform functionality.
Portal access is provided as a convenience and is subject to operational, security, and administrative limitations. We do not guarantee indefinite availability unless otherwise stated.
9. POTENTIAL ACCOUNT MAINTENANCE SUBSCRIPTION (OPTIONAL)
A. No Automatic Fee at Account Creation
Creating an account or client portal does not automatically enroll you in any recurring subscription fee.
B. Reservation of Right to Offer Maintenance Subscription
Express Divorce USA reserves the right, in the future, to offer an optional Account Maintenance Subscription (e.g., $99 per month). The subscription may include:
- Continued portal access
- Ongoing data storage
- Platform availability
- System maintenance
- Administrative support
- Eligibility for future services
C. Advance Notice and Affirmative Consent Required
No charges will occur unless you affirmatively accept the subscription via explicit consent.
D. Cancellation
Subscriptions may renew automatically unless canceled. Users may cancel at any time; cancellation takes effect at the end of the current billing cycle.
E. No Legal Services
Account Maintenance Subscription is a technology and administrative service only, and does not include legal advice or representation.
10. DATA USE AND COMMERCIAL ACTIVITIES
Your use of the Platform is governed by our Privacy Policy. You acknowledge that Express Divorce USA may collect, use, share, and sell certain categories of Personal Information for commercial purposes, as disclosed therein.
You are responsible for understanding the limitations and potential uses of your data.
Data Commercialization Acknowledgment and Consent:
By accessing or using the Platform, you expressly acknowledge, understand, and agree that Express Divorce USA's services are offered in part in exchange for your consent to the collection, use, analysis, commercialization, licensing, and sale of your Personal Information and related data as described in the Privacy Policy.
You further agree that such data commercialization is a material term of this Agreement and that you would not be permitted to access the Platform absent such consent, except where prohibited by applicable law.
11. AUTOMATION AND AI-ASSISTED SYSTEMS
You acknowledge that the Platform uses automated and AI-assisted systems to generate drafts, populate forms, and detect inconsistencies.
All outputs are subject to your review and approval, and Express Divorce USA is not responsible for errors, omissions, or legal consequences resulting from automated outputs.
12. INTELLECTUAL PROPERTY
All Platform content, software, workflows, templates, designs, and trademarks are the exclusive property of Express Divorce USA LLC. You are granted a limited, non-exclusive license for personal use only.
13. USER OBLIGATIONS
You agree not to misuse the Platform, provide false information, interfere with system integrity, or use the Platform for unlawful purposes.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- Express Divorce USA shall not be liable for indirect, incidental, consequential, or punitive damages.
- Total liability shall not exceed the amount paid by you for the relevant service.
- We are not responsible for legal outcomes, errors in user-provided data, or actions taken based on automated outputs.
15. INDEMNIFICATION
You agree to indemnify and hold harmless Express Divorce USA LLC and its affiliates from claims arising from your use of the Platform, violation of these Terms, or reliance on automated documents.
Waiver of Claims Related to Data Use:
To the maximum extent permitted by law, you waive any and all claims against Express Divorce USA arising from or related to the lawful collection, aggregation, analysis, sale, or commercial use of your data as disclosed in the Privacy Policy, including claims based on privacy, confidentiality, emotional distress, or economic loss.
16. TERMINATION
We may suspend or terminate access for:
- Non-payment
- Fraud
- Abuse
- Violation of these Terms
Upon termination, all licenses immediately cease.
17. DISPUTE RESOLUTION AND GOVERNING LAW
These Terms are governed by the laws of the State of Wyoming.
Disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
You waive the right to a jury trial and class actions.
This arbitration provision applies to all claims arising from or related to data collection, data sale, commercial use of information, or privacy practices.
18. MODIFICATIONS
We may modify these Terms at any time. Updated Terms take effect upon posting. Continued use constitutes acceptance.
19. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is invalid, the remaining provisions remain enforceable.
These Terms and the Privacy Policy constitute the entire agreement.
